PDP sues Speaker, 20 Kwara lawmakers for defecting to APC


The Peoples Democratic Party, PDP, has sued the Speaker, Razak Atunwa, and 20 other members of the Kwara State House of Assembly to court over their defection to the All Progressives Congress.

In the suit filed at the Federal High Court, Ilorin, on Friday, the state chapter of the PDP and a suspended member of the assembly, Iliasu Ibrahim, prayed the court to declare the seats of the 21 lawmakers vacant.

The plaintiffs joined the Independent National Electoral Commission, INEC, as a defendant in the suit Number FHC/IL/C5/4/2014. Continue…

The originating summons was supported by a 24-paragraph affidavit deposed to by Mr. Ibrahim.
The plaintiffs urged the court to evoke provisions of Sections 109 sub-section 1 (g), 153 (f) and 15 (a) of Part 1 of the Third Schedule of the 1999 Constitution.

They averred that the defendants had vacated their seats in the assembly.
According to the plaintiffs, the lawmakers ought to vacate their seats in the House since they defected from the PDP on which platform they secured the seats.

The PDP and Mr. Ibrahim are also asking the court to order the INEC to conduct fresh elections to fill the seats allegedly vacated by the legislators.

The plaintiffs claimed that this would be in line with the provisions of Sections 153 (f) and 15 (a) of Part 1 of the Third Schedule of the 1999 Constitution.

They urged the court to restrain the defected lawmakers from parading themselves as members of the House or performing duties relating to their respective offices.

The plaintiffs also prayed the court to order the defected legislators to refund and return to the state’s treasury, any money they collected as from January 22, when they defected to APC.
No date has been fixed for hearing on the case.

Before the lawmakers defected to the APC, the state governor, Abdulfatah Ahmed, had in November 2013, decamped to the APC.

14 year old boy locked up in Iyaganku cell in Ibadan

I got an email from a LIB reader who claims he was recently locked up at a police station called Iyaganku Police Station in Ibadan. While there, he says he saw two boys less than 16 years old who have been locked up there for a few years. I decided to share his mail here just in case. See it below

Hi Linda, I am writing you regarding something I saw some days back in Iyaganku Police Station Ibadan. I was detained by some Policemen of Iyaganku in Ibadan, after which I was put in the cell because I wont co-operate with them. Surprisingly, a boy of about 13-14yrs old came out of one of the cells, I wasn’t sure of what I saw because its awkward to find someone so young in a cell, I believe for whatever crime he must have commited, he shouldn’t be locked up in a cell, so when I got into my own cell, where I met about 6 other people in the cell, I told them what I saw and to my surprised they weren’t shocked, they told me, its no news that the boy is called “State” and he’s been locked in that same Iyaganku Cell for over 5yrs, with my calculation, the boy is 14yrs old now, that means he’s been locked up since he’s 9, when I asked for his crime, I was told he is locked up there because he pushed someone into a well and the person died. My Point is this, yeah, the boy committed a crime, but at 9, and this crime is not even something that he must have done intentionally, even if he did intentionally, that is no reason why he should be locked up in a cell for 24hrs let alone 5yrs. My reason for writing you is because I cant bring the boy out of the cell, but I know the media can, that is why I am writing you if there is any human Right Activist you can talk to about this, or if there is something you can do to get the boy his freedom.
I also want you to know that the boy I saw is not even the person who has been locked up for 5yrs, he’s just another minor locked up in Iyaganku Police Station, that means they had 2 boys of less than 16yrs old locked up in Iyaganku police station as of Wednesday 05-02-2014
Please and Please. I left Iyaganku that same day but I couldn’t sleep well because I know what I saw is not right and I shouldn’t just be silent about it.
I would speak to as many people as possible of which you are the fourth person I am writing to about it. I am hoping something would happen soon.

A group of soldiers in the Central African Republic lynched a man they suspected was a rebel minutes after hearing the new president’s promise to restore security at a ceremony to reinstate the divided country’s armed forces.

About 20 uniformed soldiers accused a member of the crowd of having belonged to Seleka – the mostly Muslim rebel group that seized power in a coup last March, before stabbing him repeatedly until he was dead.

A soldier stamped on the lifeless body, which was then dragged nearly naked through the streets as residents looked on and took photographs.

Ten minutes earlier the new interim president, Catherine Samba-Panza, stood just 20m away where she addressed a crowd of at least 1,000 soldiers.

The Army effectively disappeared during nine months of Seleka rule.She told the gathering at a training ground in the capital Bangui: ‘Within a month, I would like to fully secure the greater part of the country and I aim to stick to my word.’

Seleka disbanded after Samba-Panza’s inauguration last month and is deeply resented by the Christian majority after months of lootings and killings.
Peter Bouckaert, emergencies director at Human Rights Watch in Bangui, tweeted that the corpse of the lynched man had been burned. 

He posted a photograph showing a man holding up a severed limb next to a bonfire, as an armed French soldier gestured in the background.

A woman discovered a new use for Facebook after she discovered her husband had married a new wife through his Facebook page.

Mail Online reports Nicolette Smith was further devastated when she noticed Stephen Smith, 52, had married Awa Jobarteh, 19, at the same African register office they tied the knot at seven years earlier.

Ms Smith then called the police, but incredibly her cheating former partner has avoided jail and claimed he was the victim.

The factory worker had been abandoned by his new young bride two days after arriving back in the UK, and she has never been traced.

Nicolette met her husband in 2001, after his first divorce, but has been left in financial ruin after their marriage breakdown.

She was declared bankrupt when Smith failed to pay the mortgage and is still waiting for her husband to sign divorce papers, Teesside Crown Court was told.

The 52-year-old was prosecuted for bigamy after he admitted ‘hastily’ rushing down the aisle with his third wife because he was in love.

The court heard that the day before the wedding Smith signed a petition for divorce from his second wife, which carried a signature purporting to be by Nicolette – but it was faked.

Nicolette admitted she was disappointed that he was given a six-month prison sentence suspended for two years with 150 hours’ unpaid work.

‘I feel as though he’s got away with this and has been portrayed as some kind of victim himself after all that he’s put me through. He knew if he responded to my divorce petition, he’d give away where he’d been hiding,’ she said.

Discussing the way he was dumped by his new bride she told The Sun: ‘She looked so young in the pictures and he looked a little pathetic. I don’t know what else he could have expected’.

Smith claimed he was a wronged victim, duped and abandoned by his latest spouse after he met her in Gambia, married her on November 7, 2012 and brought her to the UK.

Smith married his second wife in December 2005. The marriage broke down two years later.

He went missing and her solicitors received no reply in efforts to start divorce proceedings. She then reported him to the police when she found out that he’d remarried.

Smith admitted a charge of bigamy, his first crime but said he had thought he was divorced and that his divorce was ‘automatic’.
